These terms cover your use of WaxUp. By using the app, you agree to them. We have tried to keep them short and readable. If anything is unclear, email support@rae-apps.com.
Who we are
WaxUp is built and operated by Rae-Apps LLC (Really Awesome Engineering), a single-member limited liability company organized in California. Our registered address is [TO CONFIRM: registered business address — match the Privacy Policy].
Eligibility
You may use WaxUp if:
- You are at least 13 years old — or 16 where your local law requires a higher age.
- You can form a binding contract under your local law.
- Your use of the app is permitted in your country.
If you are using WaxUp on behalf of an organization, you confirm you have authority to bind that organization to these terms.
Your account
To use most features you sign in with Sign in with Apple. You are responsible for keeping your Apple ID secure. If someone gains access to your Apple ID, they may also gain access to your WaxUp account.
If you suspect unauthorized access, sign out, change your Apple ID password, and email us if anything looks wrong on your WaxUp account.
You may delete your account at any time: Settings → Account → Delete Account. Deletion is final and removes server-side and on-device data within 30 days.
Subscriptions and billing
WaxUp Premium is offered as a recurring subscription:
- $4.99 per month, or
- $39.99 per year (effective $3.33 per month), with a two-week free trial.
Apple handles all billing through your App Store account. We never see your payment details.
Renewal. Subscriptions renew automatically at the end of each billing period until cancelled. Apple will charge your payment method 24 hours before renewal.
Cancellation. You can cancel anytime in your iPhone Settings → [Your Apple ID] → Subscriptions → WaxUp. Cancelling stops the next renewal; your subscription remains active for the rest of the period you have already paid for.
Refunds. Apple, not WaxUp, handles refund requests. Open reportaproblem.apple.com to request one. We cannot issue refunds directly because we never received the payment.
Free features. The widget, the gear catalog, and reading gear reviews are always free.
Acceptable use
You agree to use WaxUp only for lawful purposes. You agree not to:
- Post gear reviews that are abusive, harassing, defamatory, sexually explicit, hateful, or illegal.
- Post reviews that contain personal information about other people without their consent.
- Post reviews that you did not write yourself, or that misrepresent your experience with the gear.
- Use the app to spam, scrape, or attempt to extract data at scale.
- Reverse-engineer, decompile, or attempt to derive the source code of the app.
- Use automated tools, bots, or scripts to interact with the app.
- Interfere with the app’s operation or other users’ use of it.
- Impersonate anyone or misrepresent your affiliation with any person or entity.
We may remove content, suspend, or terminate accounts that violate these rules. Repeated or serious violations result in permanent removal.
User-generated content (gear reviews)
When you post a gear review, you keep ownership of what you wrote. You grant WaxUp a worldwide, non-exclusive, royalty-free license to display, distribute, and store your review within the app and any future official WaxUp surface (website, social media accounts when posted by you in connection with the gear, etc.).
You confirm that:
- The review is your own original opinion.
- You have not been paid by the gear manufacturer or seller to write it. (If you have a relationship that affects your view of the product, disclose it in the review.)
- The review does not contain confidential information, trade secrets, or content that infringes anyone’s rights.
We may remove reviews that violate these terms or our acceptable use rules, or that are reported by other users and reviewed by us.
If you delete a review, the public version disappears immediately. Backups may retain it for up to 30 days for operational reasons before being purged.
Safety — the most important section
Surfing carries real risk. Drowning, head injuries from boards or rocks, marine animals, hypothermia, and fatigue are not theoretical. Beginners are at higher risk than experienced surfers because they read conditions less accurately, fall more often, and tire faster.
WaxUp is an information tool, not a coach, lifeguard, or emergency service. We translate forecast data and provide beginner-friendly context. Every decision to enter the water is yours. Conditions change faster than any forecast can predict. A “good” rating from WaxUp does not guarantee safe surf — and a “poor” rating does not mean disaster, just that the day is unlikely to be good for you.
You agree to:
- Never surf alone if you are a beginner.
- Surf at lifeguarded beaches when you can.
- Wear a leash. Wear a wetsuit appropriate to the water temperature.
- Know the local hazards (rocks, rip currents, marine life, boat traffic).
- Check conditions in person before paddling out, even after consulting WaxUp.
- Stay within your skill level. Walk away if conditions exceed it.
- Not surf under the influence of alcohol or drugs.
- Follow lifeguard instructions and local water-safety rules.
Water quality. WaxUp surfaces water quality warnings derived from public data and recent rainfall. These warnings are advisory. We do not test water ourselves. Always defer to official health and beach closure notices from local authorities.
Rip currents. WaxUp displays National Weather Service rip current forecasts where available. The NWS data is provided as-is. We do not modify their predictions and we cannot guarantee accuracy.
WaxUp does not call emergency services for you. If you or someone else is in trouble in the water, call your local emergency number (911 / 999 / 000 / 112).
Intellectual property
WaxUp’s name, logo, app interface, original written content, and gear catalog database structure are owned by Rae-Apps. You may not copy, modify, distribute, or create derivative works from these without our written permission.
Surf forecast data, weather data, and water quality data are sourced from third parties. Their respective rights apply.
Disclaimers of warranties
WaxUp is provided “as is” and “as available.” To the maximum extent allowed by law, we disclaim all warranties — express, implied, statutory, or otherwise — including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- Surf forecasts, water quality data, tide tables, or rip current forecasts are accurate, complete, or timely.
- The app will be available without interruption.
- Bugs will be fixed within any specific timeframe.
- The app is suitable for any purpose other than general information.
Limitation of liability
To the maximum extent allowed by law, WaxUp and its operators are not liable for:
- Indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, or goodwill.
- Any harm arising from your decision to enter the water based on information from the app.
- Any injury, illness, or death related to surfing or water activities.
Our total liability for any claim related to the app is limited to the amount you paid us for WaxUp in the 12 months before the claim arose, or USD $100, whichever is greater.
Some jurisdictions do not allow these exclusions or limitations. In those jurisdictions, our liability is limited to the smallest extent permitted by law.
Indemnification
You agree to indemnify and hold WaxUp harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the app, your violation of these terms, your gear reviews or other content, or your violation of any third-party right.
Termination
You can stop using WaxUp at any time by deleting the app and your account.
We can suspend or terminate your access if you violate these terms, engage in fraud or abuse, or if we are legally required to. Where reasonable, we will give you notice and a chance to fix the issue first.
When your account is terminated, the subscription, account, and most data are removed as described in the Privacy Policy. Some data may be retained for legal, fraud-prevention, or backup-rotation reasons for a limited time.
Changes to these terms
We may update these terms. When we do:
- Update the “Last updated” date at the top.
- Show an in-app notice the next time you open WaxUp.
- For material changes, give at least 30 days’ notice before they take effect.
If you keep using the app after changes take effect, you accept the new terms. If you do not agree, stop using the app.
Governing law and disputes
These terms are governed by the laws of the State of California, United States. Any dispute will be resolved exclusively in the state and federal courts located in California.
If you live in the EU, UK, or another region with consumer protection laws that override forum selection, you may bring claims in your local courts and your local consumer protection rights are not waived.
Severability and entire agreement
If any part of these terms is found unenforceable, the rest stays in effect. These terms, together with our Privacy Policy, are the entire agreement between you and WaxUp regarding the app.
